Introduction. Tinery Inc. (“we” or “us”) provides a travel planning and organization platform and app as well as related services or products (collectively, “Services”).
Your Agreement. By using or engaging with the Services, you agree to this document and our Privacy Policy.
Information. You agree to provide us with accurate, current and complete information and keep same up to date. You are solely responsible for the security of your account information.
Acceptable Use. You agree not to do the following:
disrupt the Services, access non-public areas of the Services, attempt to interfere with our infrastructure or try to circumvent this document;
misuse the Services, including by carrying out any fraudulent activities, impersonating others, spamming, threatening or inappropriate behaviours or violating any law or the rights of others; or
post or share anything that is deceptive, malicious, fraudulent, illegal, obscene or otherwise inappropriate or that contains viruses or other harmful materials.
Payments. By registering for a paid subscription or plan (a “Plan”), you agree (i) to pay the then-current fees, (ii) you will be billed on a recurring basis on the first day of each billing period and you authorize us to charge your payment method, (iii) unless otherwise indicated, Plans continue indefinitely until cancelled, (iv) any cancellations take effect from the end of the billing period in which you cancel and (v) we do not provide refunds or credits.
Children. Accounts for children must be created and supervised by a parent or legal guardian. By doing so, the parent or legal guardian agrees to this document on the child’s behalf and assumes full responsibility for the child’s use of the Services.
Communications. By registering with us, you agree to receive electronic communications and notifications from us.
Licence And Use. We grant you a non-exclusive, non-transferable, non-sublicensable, revocable and limited permission to access the Services for your own personal, non-commercial purposes that are legal, in accordance with this document and in a way that does not infringe the rights of anyone else or restrict the use or enjoyment of the Services by anyone else. We retain the right to deny access to the Services at any time and for any reason at our sole discretion.
Ownership. We and our licensors exclusively own all rights, title and interest in and to the intellectual and proprietary rights in the Services. This document does not grant you any such rights, title or interest except as set out in section
. Indemnification And Limitation Of Liability. To the fullest extent permissible under applicable law: (i) you agree to defend and indemnify us and our licensors, shareholders, directors, officers, employees and contractors (the “Indemnified Parties”) from and against any claim or damages asserted by any third party arising in connection with your access to the Services and (ii) none of the Indemnified Parties will be responsible or liable for any actions, decisions or omissions by you or for any disputes, losses or damages that may arise from the use or misuse of or otherwise in connection with your involvement with the Services (including any outages in Services).
. Disclaimer. The Services are provided “as is” and “as available” without warranties or conditions. We do not control, verify or endorse any content, data or communications posted, uploaded or transmitted through the Services by its users and we are not responsible for same.
Other Terms. The laws of Ontario, Canada govern this document and any disputes. If any provision is illegal or unenforceable, then that provision will be severed from this document. This document, our Privacy Policy and any other agreement you enter into with us make up the entire agreement between you and us.
Updates. We will periodically review and update this document and may notify you of significant updates.
