This End User License Agreement ("Agreement" or "EULA") is a binding legal contract between you (an individual user) and TINERY Inc. ("Company", "we", "us", or "our") governing your use of the mobile application named TINERY (the "Application").

By downloading, installing, or using the Application, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the Application.

1. ACKNOWLEDGEMENT.
   This Agreement is concluded between you and TINERY Inc. only, and not with Apple Inc. ("Apple"). TINERY Inc., not Apple, is solely responsible for the Application and the content thereof. To the extent this Agreement provides for usage rules for the Application that are less restrictive than or in conflict with the Apple Media Services Terms and Conditions, the more restrictive or conflicting Apple term applies.
   
   

2. SCOPE OF LICENSE

   TINERY Inc. grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited license to run, view, and use the Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
   
   

3. USER-GENERATED CONTENT (UGC) SAFETY POLICY

   TINERY allows users to post, upload, transmit, or share text, images, and other materials ("User-Generated Content" or "UGC"). You are solely responsible for the UGC you make available through TINERY.
   
   

   3.1 Strict Zero-Tolerance Policy

   TINERY Inc. enforces a strict, zero-tolerance policy toward objectionable content and abusive behavior. You explicitly agree that you will not post, upload, publish, submit, or transmit any UGC that:

   • Is defamatory, obscene, pornographic, vulgar, or offensive;

   • Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group;

   • Is violent or threatening, or promotes violence or actions that are threatening to any person or entity;

   • Promotes illegal or harmful activities or substances;

   • Infringes, misappropriates, or violates a third party's patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy.
     
     

   3.2 Moderation, Reporting, and Blocking

   To ensure a safe environment, the Application provides built-in safety mechanisms:

   • Reporting Mechanisms: Any user can flag or report objectionable content or abusive users directly within the Application interface.

   • Blocking Mechanisms: Users have the right to block any other user instantly, preventing further communication and hiding their content.

   
   3.3 24-Hour Enforcement Action

   TINERY Inc. actively reviews all reports. We reserve the right, but assume no obligation, to pre-screen, filter, review, or hide any UGC.

   If content or a user is reported, TINERY Inc. will investigate and take appropriate action within twenty-four (24) hours. Violations of this safety policy will result in:
   (1) The immediate removal of the offending objectionable content; and/or

   (2) The immediate suspension or permanent ban of the abusive user’s account.
   
   

4. MAINTENANCE AND SUPPORT

   TINERY Inc. is solely responsible for providing any maintenance and support services with respect to TINERY, as specified in this EULA or as required under applicable law. You and TINERY Inc. acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

5. NO WARRANTY

   The Application is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, Apple will have no warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of TINERY Inc.
   
   

6. PRODUCT CLAIMS

   You acknowledge that TINERY Inc., not Apple, is responsible for addressing any claims of the end-user or any third party relating to the Application or the end-user’s possession and/or use of that Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
   
   

7. INTELLECTUAL PROPERTY RIGHTS

   You and TINERY Inc. acknowledge that, in the event of any third-party claim that TINERY or your possession and use of TINERY infringes that third party’s intellectual property rights, TINERY Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
   
   

8. LEGAL COMPLIANCE

   You must represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
   
   

9. THIRD-PARTY TERMS OF AGREEMENT

   You must comply with applicable third-party terms of agreement when using the Application (e.g., your wireless data service agreement).
   
   

10. THIRD-PARTY BENEFICIARY

    You and TINERY Inc. acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
